  • The party filing for divorce must be a Nevada resident for at least six weeks before the filing date.
  • A resident witness will need to sign an affidavit stating your residency in Nevada (relatives are allowed).
  • Grounds: You and your spouse must either be incompatible in marriage or have lived separately and apart for at least one year.
  • If you and the other party have children together, each party will also need to attend a ½ day Court Mandated Divorce Seminar (approx. $40) required by the State of Nevada.
  • If one party resides out of State they may qualify for a waiver, or in some cases they may be required to attend a similar class in their State if one is available.
